⚖️ New Labour Code — impact on your salary
India's 4 Labour Codes — what changes for you
Code on Wages, 2019
Basic wage must be ≥50% of total pay. Minimum wages now cover all workers. Overtime at 2× the rate.
Code on Social Security, 2020
PF and gratuity will be linked to the new higher Basic wage base. Gig workers also get social security coverage.
Code on Industrial Relations, 2020
Establishments with <300 workers can hire/fire without government permission. Fixed-term employment standardised.
Pending notification — watch for updates
Code on Occupational Safety, Health & Working Conditions, 2020
Maximum 48 hrs/week, 8 hrs/day. Mandatory annual health check-ups. Better protection for migrant and contract workers.
Benefit — protects employee rights
⚖️
Fired from your job? Know your rights.
You are not powerless. Indian labour law provides strong protections. Most employers will settle rather than go to a Labour Court.
⚠️
Key laws protecting you: Industrial Disputes Act 1947 (wrongful termination), Payment of Gratuity Act 1972, EPF & Miscellaneous Provisions Act 1952, Payment of Wages Act 1936. If your employer has 10+ workers and you're a "workman", these laws apply to you.
💸
Notice Pay entitlement
If terminated without serving notice, you're entitled to salary for the entire notice period. Usually 1–3 months depending on contract.
🏆
Gratuity (5+ years)
If you've worked 5+ years, you're legally entitled to gratuity = (Basic × 15 × years) ÷ 26. It cannot be withheld on termination.
💼
PF withdrawal rights
Your entire employee PF share is yours always. After 2 months of unemployment, you can withdraw full PF balance from EPFO.
⚖️
Wrongful termination
If terminated without cause, file under Section 25F of the Industrial Disputes Act. You may be entitled to retrenchment compensation.
Step-by-step: what to do if fired
Get termination in writing within 48 hrsAsk for a formal termination letter with reason, last working day, and settlement details.
Calculate dues owed to youAdd up: notice pay + pending salary + gratuity (if 5 yrs) + leave encashment + bonus. Get it in writing from HR.
File PF withdrawal claimGo to EPFO Unified Member Portal (uanmembers.epfindia.gov.in). After 2 months unemployment, claim full PF. Transfer if re-employed.
If dues not paid within 2 monthsFile a complaint with the Labour Commissioner of your state. This is free and fast — most employers settle promptly.
Escalate if neededApproach the Industrial Tribunal or Labour Court for wrongful termination / non-payment. Hire a labour lawyer — fee is often contingency-based.
